We've been tracking the most common listing errors (some resulting in fines) and thought you'd like to see the summary:
Contract date entered incorrectly - Please remember that the listing agreement indicates that the term of the contract begins on the date of the seller's signature. This MUST be the listing date entered into the MLS System, and the expiration date calculated based on the date the seller signed the agreement. In the instance of multiple sellers, it is the date of the last legal seller's signature.
No MLS Number on Contract - We verify all listings in the MLS and the process is severely hampered if we have to track down the MLS number for the thousands of pages of contracts we receive each year. Please make sure all contracts have the MLS number clearly printed on the contract before faxing. Many thanks!
Ah yes, faxing your contract to the Board Office - According to the legally binding contract terms and the MLS rules, your Exclusive listing must be entered and sent to the MLS Office within two (2) business days of the seller's signature.
Correct information must be entered into the system or else the Board Office staff must change it to reflect the actual contract terms. On each listing we verify: seller's signature and date, broker's signature and date, MLS # and all changes in the contract must be initialed (i.e., price change, duration, dates). Please make sure the compensation you have offered in the MLS reflects what was disclosed to the seller as well.
Missing Seller(s) signature: Seems like a no-brainer, but just a reminder that if you don't have the seller's signature allowing you to exclusively market and sell the property, entry in the MLS is not valid and will be withdrawn from the system
